Imagine shortlisting a vast tract of land, succumbing to the seller's sweet promises about how perfect the land is, for full ownership, only to realize it falls under comunidade property, sold without any legal action taken. This is precisely the reason why you, as a potential buyer, must be aware of the five most important documents that can either make or break your next land purchase in Goa.
Goa is an exotic settlement destination for many. Prospective buyers often find themselves shortlisting lands in the quiet of the North or the coastal landscapes of the South. But before being swayed by the irresistible beauty of the state, you must demand these certificates from the seller.
Forms I & XIV
Just having sufficient capital isn’t enough for land possession. Instead, it involves a stringent process of scrutinizing any and every document related to the details of the concerned property. These details could include ownership details, historical records of the land, and more. So, you’re aware and alert.
Acting as the Record of Rights (RoR), Forms I & XIV are two of the most crucial official land record documents in Goa. Addressing property ownership, area size, land classification, tenancy, and third-party rights of rural and agricultural lands, these documents provide up-to-date information about the land in question.
The Difference Between the Form I And Form XIV
Both forms serve similar but different purposes:
Form I focuses on land rights and associated encumbrances, survey number, subdivision number, land size, and description. This helps you understand the property’s registration details and whether it is agricultural, residential, or commercial, as well as the names of occupants.
Form XIV, on the other hand, deals with property ownership details, stating the occupancy and/or tenancy details at the time of application as issued by the Goa, Daman and Diu Agricultural Tenancy Act, 1964, clarifying which other rights have been registered.
Why do these Forms Matter?
Your interest lies in leveraging these forms as assurance for future property transactions, title verification, loan applications, and even legal disputes. Because these aren’t just any forms, but a critical legal record of your land.
How to get Form I and XIV?
Forms are available online at https://goaonline.gov.in/ under the revenue department. Maintained by the Directorate of Settlement & Land Records (DSLR), these records can be viewed by you as an information-only copy on the DSLR portal. For anything to be submitted to a bank or court, order the digitally signed copy through the Goa Online portal. Cross-check the survey number against the old Portuguese Matriz and Escritura. If it records a mismatch, it’s exactly the kind of loophole that unravels a title years down the line.
Conversion Land/Sanad
Goa spreads across a wide stretch of green land. But here’s the catch. Most land falls under different land categories, as the government recognizes them. Agricultural lands are protected by law codes. So, before you eye any agricultural property, you must seek the Sanad.
What is a Sanad?
Conversion Sanad is a critical legal certificate issued by the Revenue Department through the concerned Deputy Collector, Collector of the district, and SDO of the Taluka in Goa under Section 32 of the Goa Land Revenue Code.
Sanad certificate offers legal transfer of agricultural land, granting permission to utilize agricultural land for commercial or residential purposes. Hence, the Sanad changes the land use classification. While a construction license allows you to build on it.
How to get a Conversion Sanad in Goa
Conversion Sanad is issued under Section 32 of the Goa, Daman and Diu Land Revenue Code, 1968 (with the 1969 Conversion Rules). As per the South Goa and North Goa District government, applications for conversion below 500 sqm go to "the concerned Deputy Collector & SDO of Taluka," while those above 500 sqm go to "the Collector," filed "in Schedule-I affixing therein court fee stamp of Rs. 5/-."
Why does the Sanad Need to be Verified?
You might wonder why the details issued in the Sanad decades ago don’t match the ones in the current certificates. This makes it necessary to verify this certificate. Also, check the conversion purpose if it’s commercial, residential, or industrial.
As a buyer, the land needs to be verified and not just applied for. For this reason, applications for plots up to 500 sq m go to the Deputy Collector & SDO, and for plots above that, they go to the Collector, along with title documents, a survey plan, a site plan, and a mutated Form I & XIV. Your role is to check if the survey number of the existing Sanad matches the exact plot you’re buying.
Under the Goa State Amritkal Agriculture Policy 2025, launched on 11 February 2025 by Chief Minister Pramod Sawant, the government moved to bar conversion of rice, Morad, Ker and Khazan fields. As Sawant put it, "Even if the Town and Country Planning Department approves conversion of agricultural fields, the NOC from the agriculture director would be mandatory… no NOC will be granted for any such conversions.” So, the bottom line is not all agricultural lands are free to be converted.
Comunidade Land Goa
If you find yourself fascinated by old houses, you are possibly looking at centuries-old, village-level communal associations unique to Goa, which are vast tracts of land, traditionally managed through hereditary stakeholders known as Gaunkars. The village as a body owns it.
Dating back to pre-Portuguese times, these agricultural lands are governed and protected by the comunidades under the Code of Comunidades, 1961 (Legislative Diploma No. 2070 dated 15 April 1961), supervised by an elected committee.
You must’ve come across a common term associated with the comunidades, "Aforamento," a tenancy right that provides individuals with a long-term lease or tenancy of the land, while ultimate ownership remains with the village. This “sale deed” is a transfer of limited, not full, ownership.
Comunidade NOC
Buyers must seek a Comunidade NOC or redemption certificate proving 20x foro paid, ensuring legal transfer of occupancy rights; any construction activity on the said land and mortgaging of any rights. This certificate is issued by the Acordado, the comunidade managing committee.
Gomantak Times reports, "The Supreme Court of India in a judgement mentioned that Comunidade land is 'inalienable.' "Aforamento (leasehold) foros are redeemable. As per the Goan (citing senior advocate M.S. Usgaocar), "after passage of 20 years… by payment of 20 years of instalments," the genuine, legitimate path by which former Comunidade land changes hands.
Why is an NOC needed?
Many legal disputes regarding land settlements lead back to fraudulent "freehold " ownership of comunidade land and discrepancies in the transferable rights of the seller without an NOC, which means your plot can be contested in court even decades later, and the legal side will be against you.
Recently, there was a massive uproar with regards to the Goa Legislative Diploma No. 2070 dated 15 April 1961 (Amendment) Bill, 2025, Bill No. 39 of 2025, which sought to insert a new Article 372-B in the Code, creating a mechanism to regularize dwelling houses built before 28 February 2014 on land belonging to a Comunidade without a lawful grant.
This proposition faced extreme opposition. Business Goa reported, “67 Comunidade Presidents convened in Chinchinim, unanimously resolving to challenge the decision in the Supreme Court, viewing it as a direct threat to heritage, ecology, and traditional land rights.”
You can check comunidade land history at the village Comunidade Office, which stores the lease records, and convoke the Acorodo, while the Department of Revenue at goa.gov.in supervises Comunidades and holds gazette references. Just carry the survey number, subdivision, taluka, and the seller's deed bundle, clearly naming you.
Encumbrance Certificate Goa
What if you’re tricked into finalising a land purchase that has a history of mortgages?
Well, an encumbrance certificate will save you big time. As an official document from the sub-registrar issued under the Indian Registration Act,1908, through the goaonline.gov.in portal. This document lists the mortgages, sales, and attachments registered under a property for a specific period; it covers Sale Deed, Gift Deed, Mortgage Deed, Court Attachment, and Lis Pendens against the land during that period. So, anything suspicious can be found at this stage only. Factor out secret mortgages. Give a track record of the entire plot.
If nothing shows up, it's nil encumbrance, enough of a green signal to safely make the land yours.
If something shows up, you as a buyer can either ask the seller to clear the encumbrance or factor the cost and risk into the purchase.
Why is formal encumbrance registration mandatory in Goa
Elsewhere in India, an informal handover of original documents between the buyer and the lender with no formal registration was fine. In Goa, due to the Portuguese Civil Code (1867), unregistered mortgages cannot count as formal security interests.
As a buyer, you must be aware of the EC and the original title deed so you are not cheated because an old, unreleased mortgage can come back to haunt you. But hold on, although it might expose the history of the property, it is not completely accurate, as there might be under-the-table agreements that are unregistered.
Where to apply for the Encumbrance Certificate
You can get the Encumbrance Certificate from the office of the Civil Registrar-cum-Sub Registrar of the relevant taluka, where the property is registered. You apply in the specified format with the property details, pay a modest fee scaled by the number of years searched (up to 30 years), and the office searches the Mortgage Index. If it's clean, you get a Nil Encumbrance Certificate.
TCP Zoning Certificate
Once you own a piece of land, you can’t build whatever you wish to. Land looks completely normal but can sit on restricted areas. The Town and Country Planning Department validates the demarcated land and dictates the designated zone of the land under Goa’s Regional Plan through the zoning certificate, confirming whether it’s a Settlement Zone, Agricultural Zone, Orchard Zone, Forest/No-Development Zone, Eco-Sensitive Zone, or CRZ-affected area, which are heavily restricted areas. Zoning clearance.
Why does zoning status matter?
You just get clarity on what you’re allowed to build and how much. So whether the land is for permissible use, Floor Area Ratio/FAR, setbacks, or height restrictions. This certificate will be particularly crucial to get a construction license, as the local panchayat or municipality will demand this.
Land near the coast, backwaters, or rivers must be checked against Coastal Regulation Zone (CRZ) maps or notifications.
Apply to the TCP Department with your survey plan and Form I & XIV for the Zoning Certificate. For coastal plots, cross-check the plot against the official CRZ maps and the current Goa Regional Plan.
If a seller can't produce a Zoning Certificate and the Sanad for a "converted" plot, treat the land as not ready to build, whatever the brochure promises.
Goa Land Due Diligence Checklist
- Form I and XIV — Documents basic survey data and current possession of the property.
- Title Search — Investigates ownership history of the property for the last 30 years.
- Encumbrance check — It reflects the history of mortgages and disputes subject to the land.
- Comunidade /Sanad — Agricultural lands that cannot be owned without legal transfer or NOC but can only be leased
- TCP Zoning Check — Avoids disputes about constructing in restricted zones.
